Legal foundations for data protection can be found in the German Data Protection Act (BDSG) and in the German Telemedia Act (TMG).
Access data/server log files
The service provider (or his/her Internet service provider) shall collect data each time the site is accessed as part of an offer (so called server log files). Access data includes:
The web page, data file, date and time of the access request, the amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the page visited previously), along with the IP address and any providers making the actual request.
The service provider shall use any log data for statistical analyses used for the purpose of the operation, security and for maximising any offer. The service provider reserves the right, however, to check the log data at a later stage should there be any reasonable suspicion of unlawful use on the basis of specific patterns of behaviour.
Handling personal information
Personal data is information, which will assist in identifying an individual, i.e. information which can be traced back to one person. This includes the name, e-mail address or telephone number. However, data with regards to preferences, hobbies, memberships, or which websites have been viewed by somebody are also included as part of personal information.
Personal data is only collected, used and forwarded on by the service provider if the user gives his/her consent to the collection of data by the service provider.
Methods of contact
When contacting the service provider (for example, via the contact form or e-mail), the user's information will be saved for the purpose of processing the inquiry and in the event that any follow-up questions may arise.
Involving services and third party content
It may be possible that a section of third party content, which forms part of an online offer, for example videos posted on YouTube, cartography material on Google Maps, RSS feeds or graphics from other websites may all be incorporated. There is always an assumption under these circumstances that the service provider of this content (hereinafter referred to as a “Third Party Service Provider”) may identify the user’s IP address. They would not be in a position to send the content to the user’s browser without having ownership the IP address. The IP address is therefore a requirement in terms of being able to provide this content. We will make every effort only to use this type of content where respective service providers simply make use of the IP address for delivering this type of content. However, we do not have any control should third party service providers save IP addresses, i.e. for statistical purposes. We will request clarification from the users should we be made aware of this happening.
Withdrawal, modification, corrections and updates
The user reserves the right to find out which personal information has been saved and may submit an application to obtain this information free of charge. In addition, the user also reserves the right to correct any inaccurate information and to block and delete his/her personal information, provided that this does not conflict with any statutory duty to retain this type of data.
